Regulations for assistance to external beneficiaries (supported in connection with the experience of refugees caused by the escalation of the war in Ukraine)

Regulations for additional forms of assistance provided by Kwitnący Dom w Warszawie ul. Kwitnącej 14

(1) The organiser of assistance in the form of issuing gifts in kind or other forms of assistance is Kwitnący Dom ul. Kwitnąca 14, Warsaw.
(2) This assistance in the form of a one-off, periodic or permanent action takes place out of the goodwill of the Organiser as far as its resources allow.
(3) The organiser is under no legal obligation to the persons applying for assistance or any other persons regardless of their life situation.
(4) The assistance comes from private funds and therefore no complaints or appeals are possible.
(5) Information on the provision of assistance shall be announced by the Organiser at its discretion.
(6) The timing, extent and form of the provision of assistance shall be determined by the Organiser at its discretion, subject to its resources and organisational capacity.
(7) The information referred to in section 5 is not an offer or a public promise within the meaning of civil law.
(8) The Organiser is not obliged to notify individuals individually about the assistance offered.
(9) Assistance is provided on a first-come, first-served basis until resources are exhausted.
(10) The organiser may, without notification, apply additional conditions and criteria for granting assistance.
(11) In the case of assistance in kind in the form of giving gifts, the organiser may stipulate the amount or value of assistance given to one person, regardless of his/her life situation.
(12) It is a condition of receiving assistance that all of the following conditions are met:

  • crossing the Polish border after 24 February 2022.
  • having the UKR PESEL number,
  • for selected forms of assistance in kind, the organiser may specify the criterion -having a child/children of a certain age or the condition of being pregnant,
  • filling in the registration form, the link to which will be published by the organiser on the House’s Facebook profile,
  • receiving information by phone or email about the award and the date of collection,
  • reporting to the Kwitnąca Dom, 14 Kwitnąca St. in Warsaw on the specified date (point e),
  • presenting the documents listed in points a, b, c to the employee of the Home for inspection,
  • confirming receipt of assistance with a signature. 13.

correct completion of the registration form does not oblige the Organiser to provide assistance.
(14) Despite meeting all other conditions, assistance may not be provided to a person who has not registered by the set deadline.
(15) Assistance will not be provided to a person who has not produced the reliable documents specified in points a, b, c.
(16) The organiser reserves the right not to provide assistance to a person who has completed the registration form for a particular activity more than once.
(17) Unless otherwise specified by the organiser, any person may benefit from the various forms of assistance more than once subject to point 16.
(18) The organiser may cancel or discontinue the provision of assistance, including the distribution of donations, by announcing it in the manner in which it was announced. The organiser does not have to notify the persons to whom it has previously granted assistance individually.
(19) Persons filling in the application form, in order to obtain specific assistance, may give the Organiser their consent to process their personal data for the purpose of further assistance activities of the Organiser, including individual notification. This consent does not oblige the Organiser and is not a condition for obtaining assistance.
(20) The Organiser makes it known that the posting of questions, comments, graphic icons under the Organiser’s announcements on the profile on the social networking site about providing help is publicly visible and takes place under the sole responsibility of the person, in accordance with the rules of the site. The Organiser is not responsible for the processing of data by the provider of this service as well as other users of the service.
(21) The organiser furthermore makes it known that he places announcements about the provision of assistance on his profile on the social network exclusively for the benefit of potential beneficiaries due to the easy accessibility of these announcements.

Information on protection of personal data of beneficiaries of additional forms of material assistance of the Kwitnący Dom in Warsaw, 14 Kwitnąca St.

Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (RODO), I hereby inform that:

The administrator of the personal data is Fundacja Inna Przestrzeń ul. Nowy Świat 23/25 lok. 32, 00-029 Warsaw, NIP: 521-33-93-003, on behalf of which the Project Plenipotentiary Anna Kłos acts.

The administrator (depending on the specific scope or form of assistance) may process the following personal data:

identification data: name and surname, PESEL number, legal status in Poland,
contact data: e-mail address, telephone number, username on a social networking site,
family data: marital status, number, age, gender, personal data of children,
other data: living and material situation, clothing and shoe sizes, other specific life needs.
The purpose of the data processing is, according to Article 6(1)(f) RODO, the legitimate interest pursued by the controller – recognition of requests (fulfilment of criteria) for assistance) and, according to Article 6(1)(c), fulfilment of the controller’s legal obligation – documentation of outgoings. Data may also be processed with the consent of the data subject in order to enable the Administrator to provide further assistance.

Personal data may be shared with entities to which the Administrator is or may be obliged by law. To a limited extent, data may also be provided to donors insofar as this is necessary to obtain assistance. Data will not be transferred to a third country or international organisation.

Data will be processed (stored) for a period of 3 years after the end of the calendar year in which the assistance was provided. Data in financial and accounting records, will be stored in accordance with accounting and tax regulations for a period of 5 years. Data may be stored for a different, longer period of time insofar as this is necessary for the documentation of ongoing projects or programmes. After this period, the data will be irretrievably destroyed.

The provision of personal data by the beneficiary is voluntary, but the consequence of failing to provide personal data will be the inability to benefit from the assistance.

The subject has the right to: access to the content of their data, rectification, restriction of processing, the right to withdraw consent at any time without affecting the lawfulness of the processing (if processing is based on consent) that was carried out on the basis of consent before its withdrawal; lodge a complaint with the President of the Office for the Protection of Personal Data if it is considered that the processing of personal data violates the provisions of the RODO.

The right: under Article 17(3)(b) or (e) RODO to erasure of personal data; Article 21 RODO the right to object, to the processing of personal data; Article 20(1)(b) data portability does not apply.
